Welcome to Fly Pixel Drone Photography Services (“we,” “us,” “our”). These Terms and Conditions govern your use of our services, including drone photography and videography, primarily targeted at real estate professionals (“Client,” “you,” “your”). By engaging our services, you agree to comply with and be bound by these Terms and Conditions.
1. Services Provided
1.1 Scope of Services
Fly Pixel provides drone photography and videography services primarily for real estate professionals. This includes aerial photos, videos, and other related services as agreed upon with the Client.
1.2 Service Agreement
All services provided will be outlined in a Service Agreement, specifying the nature of the work, deliverables, deadlines, and pricing. No work will commence until the Service Agreement is signed by both parties.
1.3 Modifications and Changes
Any changes to the scope of services must be agreed upon in writing and may incur additional costs.
2. Pricing and Payment
2.1 Pricing
Pricing for services will be detailed in the Service Agreement. Prices are subject to change, but any changes will be communicated to the Client before work begins.
2.2 Payment Terms
A deposit of $100 is required upon signing the Service Agreement. The remaining balance is due upon delivery of the final product. Payments can be made via credit/debit card, Apple Pay, or Google Pay
2.3 Late Payments
Payments not received within ten business days of the due date will incur a late fee of 15% of the total amount due. Fly Pixel reserves the right to withhold final deliverables until full payment is received.
3. Client Responsibilities
3.1 Access and Permissions
The Client is responsible for obtaining all necessary permissions and access to the property where the drone services will be performed. This includes, but is not limited to, permissions from property owners, tenants, and local authorities.
3.2 Accurate Information
The Client must provide accurate and complete information about the project, including property details, shoot preferences, and any specific requirements.
3.3 Compliance with Laws
The Client must ensure that the use of drone services complies with all relevant local, state, and federal laws and regulations.
4. Deliverables
4.1 Delivery Timeframe
Final deliverables will be provided within three business days after the completion of the shoot, unless otherwise specified in the Service Agreement.
4.2 Format of Deliverables
Deliverables will be provided in digital format, via a secure online link or other agreed-upon delivery method. Physical copies or additional formats may incur additional charges.
4.3 Revisions
The Client is entitled to two revisions within 3 days of receiving the initial deliverables. Additional revisions will incur extra charges.
5. Cancellations and Rescheduling
5.1 Cancellations
Cancellations made by the Client less than four hours before the scheduled shoot will be subject to forfeiture of deposit.
5.2 Rescheduling
The Client may reschedule a shoot without penalty if notice is given at least 4 hours before the scheduled time. Rescheduling requests made with less notice may incur a rescheduling fee.
5.3 Weather-Related Cancellations
If weather conditions prevent the safe operation of drones, Fly Pixel reserves the right to reschedule the shoot. No cancellation fee will apply in such cases.
6. Ownership and Licensing
6.1 Ownership of Deliverables
Fly Pixel retains ownership of all photos, videos, and other deliverables until full payment is received. Upon full payment, ownership and licensing rights are transferred to the Client.
6.2 Use of Deliverables
The Client is granted a non-exclusive, perpetual license to use the deliverables for real estate marketing and promotional purposes. The Client may not resell or redistribute the deliverables without prior written consent from Fly Pixel.
6.3 Portfolio Use
Fly Pixel reserves the right to use photos and videos in its portfolio, marketing materials, and social media, unless the Client specifically requests otherwise in writing.
7. Liability and Insurance
7.1 Limitation of Liability
Fly Pixel is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the amount paid by the Client for the specific service provided.
7.2 Insurance
Fly Pixel carries liability insurance for drone operations. However, the Client is responsible for ensuring that the property being photographed or filmed is adequately insured.
7.3 Safety
Fly Pixel prioritizes safety in all operations. If at any time our drone operator deems a situation unsafe, we reserve the right to halt operations until the issue is resolved.
8. Confidentiality
8.1 Confidential Information
Fly Pixel agrees to keep all information regarding the Client’s business, properties, and projects confidential, except as necessary to perform the services or as required by law.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Tennessee and Georgia, USA. Any disputes arising out of or relating to these Terms and Conditions shall be resolved in the courts of Tennessee or Georgia, USA.
10. Changes to Terms and Conditions
Fly Pixel reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to the Client in writing and will apply to future services.
